Purchases

Placing an item in a shopping basket without completing the purchase cycle will not constitute or give rise to any order of products or sales agreement. Chosen Health& Wellness/Chosen Skincare may remove any such product from the basket if stock is not available, and users cannot hold Chosen Health & Wellness/Chosen Skincare responsible if such items are not available when the purchase cycle is later completed. Chosen Health & Wellness/Chosen Skincare reserves the right, for the purposes of preventing suspected fraud and with notice to you, to refuse to accept and/or process payment for an order, and/or to cancel any sales transaction in whole or in part. Small spoilage is only liable for the refund of monies already paid by the user and accepts no other liability that may arise from such refusal to process any order/sale.

Chosen Health & Wellness/Chosen Skincare reserves the right to change and modify the prices and rates quoted on this website without notice. Chosen Health & Wellness/Chosen Skincare strives to accurately describe and/or depict each product on the website. Chosen Health & Wellness/Chosen Skincare will do everything reasonably within its power to accurately indicate prices and delivery charges. However, if products are mistakenly offered at the wrong prices and/or delivery costs, Chosen Health & Wellness/Chosen Skincare will not be obliged to sell the products at such incorrect prices and/or delivery costs, but will refund any monies paid by you to you if you choose not to proceed with the purchase transaction at the correct price and/or delivery charges.

No Hidden Costs or Compulsory Purchases

There are no purchase obligations for users or clients – you order what you want, when you want.

Payment Methods

Chosen Health and Wellness/Chosen Skincare offers the following payment method:

Electronic Funds Transfer (EFT) or Direct Payments.

Delivery

For deliveries we use Courier Guy. We reserve the right to use any other service provider that is most economical if necessary. Large orders, heavy items or delivery to some areas may require additional delivery charges. Make sure you provide a valid delivery address and contact number, and select the correct delivery method and address during the online payment process. Contact us if your package is not received within the estimated delivery time. We are happy to help track the package.

Should a parcel return undelivered, we will notify you and request you to make alternative arrangements for re-delivery to you. You agree and give us power of attorney to dispose of the package, donate it, or resell it if it is not claimed within three months. Deliveries in the areas outside the service provider’s territory will be charged at a higher rate, and are additional to the price of the product purchased.

Because we make fresh products every day and receive large volumes of orders daily, processing takes 4-8 business days from order and proof of payment received until your package leaves the factory.

Refund Policy

If any product you receive is defective or damaged, you are entitled to return the product at Chosen Health & Wellness/Chosen Skincare expense for a full refund or replacement, provided that the faulty product is returned to Chosen Health & Wellness/Chosen Skincare within one week of its delivery.

Please note in this regard that:

• “defect” is not something that results from normal wear and tear;

• “damaged” means that the product must be damaged when you receive it and that it has not been damaged by you or anyone else who has received it;

• Chosen Health & Wellness/Chosen Skincare supplier will examine the returned product to determine whether the alleged problem is indeed justified or not. If the problem is not justified, you will be liable for the cost of return to Chosen Health & Wellness/Chosen Skincare, for inspection and redelivery to you. We therefore encourage you to report any problems you discover to us promptly after you discover them.

Delays – Events Outside Our Control

We will not be liable or responsible for any failure or delay in performance of any of our obligations in terms of this agreement, when caused by events beyond our reasonable control (Force Majeure). A Force Majeure includes any act, event, non-event, omission or accident beyond our control, and specifically includes (without limitation) the following:

• Lockouts, strikes or any other industrial action;

• Riots, invasions, civil insurrection, terrorist attacks or threats thereof, wars (declared or not) or threats or preparations for wars;

• Floods, fires, explosions, storms, earthquakes, subsidence, epidemics or other natural disasters;

• Cases where the railways, ships, planes, cars or any other forms of public or private means of transport are not usable;

• Case where public or private telecommunications networks are not usable; and

• The acts, orders, legislation, regulations or restrictions of any government.

Our performance under this agreement will be suspended for the period of the Force Majeure, and we will have a longer period for performance during this time. We will make a reasonable effort to stop the Force Majeure, or try to find a solution so that our obligations under the agreement can be fulfilled despite the Force Majeure.

Liability

If we fail, at any time during the agreement, to insist that you comply with your requirements under the agreement or any of these Terms and Conditions, or if we fail to exercise any of the rights or remedies available to us under this agreement is entitled to insist, it will not be considered a waiver of such rights or remedies and will not release you from your compliance with respect to such obligations. A waiver by us of any default does not count as a waiver of the subsequent default. No waiver by us of any of these Terms and Conditions will be effective unless it is clearly set forth as a waiver and communicated to you in writing.

Our Right to Amend These Terms and Conditions

We have the right to revise and adapt these Terms and Conditions from time to time to reflect: changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in the capabilities of our systems.

You will be subject to the Policies, Terms and Conditions in effect when you order your product from us, unless a change in these policies, Terms and Conditions is required by law or made by governmental authority (in which case it will apply to orders you have previously placed), or if we notify you of the change in the policies, Terms and Conditions before we send you the Confirmation of Dispatch (in which case we have the right to assume that you have accepted the change in Terms and Conditions, unless you notify us to the contrary within seven working days of receiving the products).
